These Terms of Service ("Terms") govern your use of apeaxis.com and the products and services provided by Ape Axis ("Services"). By using the Services you agree to these Terms.
01Our services
Ape Axis provides AI-powered business software and services, including:
- Caller AI voice agents for automated calling and customer conversations.
- Leads & To-Do, WhatsApp, Travel and AI Marketing CRMs.
- Battery Industry ERP and Standard ERP.
- Custom software and app development.
- Integrations, analytics and related support services.
02Agreements and accounts
Access to our products is provided under a proposal, order form or agreement signed with you. Where that agreement conflicts with these Terms, the agreement prevails. You are responsible for keeping account credentials secure and for all activity under your accounts.
03Acceptable use
You agree not to use the Services to:
- Break any law, regulation or third-party right, including telemarketing, consent and do-not-call rules.
- Send spam or unsolicited messages, or harass anyone.
- Transmit malware or attempt to gain unauthorised access to any system.
- Disrupt or overload the Services, or access them by automated means without permission.
- Reverse engineer or copy the Services except as allowed by law.
04Calling and messaging compliance
When you use Caller AI, WhatsApp or other messaging features, you are responsible for having the consents and registrations required where you operate, and for honouring opt-outs. Phone numbers arranged through our carrier partners are subject to those carriers’ terms.
05Intellectual property
The Services and all related software, content and branding belong to Ape Axis or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the Services for your internal business purposes. Ownership of custom software we build for you is set out in the agreement for that project.
06Fees and payment
Fees, billing cycles and payment terms are set out in your proposal or agreement. Unless stated otherwise, fees are payable in advance and non-refundable. Late payment may lead to suspension of the Services.
07Data and privacy
Our Privacy Policy explains how we handle personal data. When we process data on your behalf, you remain responsible for having a lawful basis to collect it and for the instructions you give us.
08Availability
We work to keep the Services available and reliable but do not guarantee uninterrupted access. Planned maintenance, emergency fixes, third-party outages and events beyond our control may cause interruptions.
09Limitation of liability
To the maximum extent permitted by law, Ape Axis is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising from your use of or inability to use the Services.
10Indemnification
You agree to indemnify Ape Axis against claims arising from your use of the Services in breach of these Terms or of applicable law.
11Termination
Either party may end the relationship as set out in the applicable agreement. On termination your access ends, outstanding fees become due, and we may delete your data after a reasonable retention period.
12Governing law
These Terms are governed by the laws of India. Courts at Gurugram, Haryana have jurisdiction, unless your agreement with us says otherwise.
